This Open Access book offers a synthetic reflection on the authors’ fieldwork experiences in seven countries within the framework of ‘Authoritarianism in a Global Age’, a major comparative research project. It responds to the demand for increased attention to methodological rigor and transparency in qualitative research, and seeks to advance and practically support field research in authoritarian contexts. Without reducing the conundrums of authoritarian field research to a simple how-to guide, the book systematically reflects and reports on the authors’ combined (...) experiences in getting access to the field, assessing risk, navigating ‘red lines’, building relations with local collaborators and respondents, handling the psychological pressures on field researchers, and balancing transparency and prudence in publishing research. It offers unique insights into this particularly challenging area of field research, makes explicit how the authors handled methodological challenges and ethical dilemmas, and offers recommendations where appropriate. Protagonista delle più celebri contrapposizioni di principio della dottrina dello Stato della prima metà del Novecento, Hans Kelsen si consolida già tra gli anni Venti e Trenta come un giurista universale. È al centro del dibattito politico e teorico che fonda nel primo dopoguerra le radici dello Stato costituzionale. Ne segue poi, un decennio più tardi, la crisi, confrontandosi in particolare con il drammatico percorso tedesco di affermazione del totalitarismo. Le critiche nei confronti del suo impianto teorico restano accese in (...) Europa anche nel secondo dopoguerra; non facile la sua penetrazione in terra americana, dopo il suo arrivo nel 1940. Le grandi opere di questo periodo, dalla General Theory alla seconda edizione della Dottrina pura, lo confermano comunque come un imprescindibile punto di riferimento per ogni riflessione di teoria generale. Solo sul finire del Novecento iniziano gli interrogativi sulla sua attualità, ripercorsi nel saggio con particolare riferimento al contesto italiano, in cui Kelsen continua a conoscere una presenza ampia e capillare. Iniziano così le prese di distanza dal suo pensiero, ritenuto lontano dal pluralismo del presente e dal paradigma dei diritti, affermatosi con il costituzionalismo del secondo dopoguerra. Mentre appaiono ancora di grande attualità sia la sua lettura critica dei presupposti del diritto pubblico costruiti dalla scienza giuridica ottocentesca, sia la sua teoria della democrazia. Medical intervention in childbirth raises a number of ethical issues which have received too little attention in American obstetrics. A number of these issues are surveyed in the first section of this essay. In the second section, the hospital and the roles characteristically ascribed to patients, staff, and obstetrical practitioners are shown to provide an unsatisfactory social setting for birth. Several proposals for improving existing arrangements or for providing alternatives are offered. Gênese e processo histórico do complexo da arte no cotidiano do ser social na Estética de Lukács Resumo: Esse artigo tem como objetivo apresentar o entendimento onto-histórico sobre o trabalho e a origem tardia do complexo da arte no cotidiano dos seres sociais. Trata-se de uma pesquisa teórico-bibliográfica e fundamenta-se, especialmente, na obra “Estética: la peculiaridad de lo estético”, de Georg Lukács. É pela via do trabalho que a significação de utilidade se transpõe a uma dimensão estética. O complexo da (...) arte se estrutura a partir do tempo livre (ócio), do desenvolvimento da técnica e, ademais, pela experiência do agradável e pela consciência do estético. Considera-se, com efeito, que muito mais do que se acercar dos fatos históricos a respeito da arte, é imprescindível reconhecê-los ontologicamente, compreendendo as necessidades assentes ao cotidiano dos indivíduos enquanto partícipes do gênero humano. Genesis and historical process of art complex in the quotidian of social being at Lukács’s Aesthetics Abstract: This article aims to present the onto-historic understanding about labor and the late origin of the art complex at the social beings’ quotidian. It is a theoretical-bibliographic research which is based, specially, at the work “Estética: la peculiaridad de lo estético”, written by Georg Lukács. It is through labor that the significance of utility is transposed to an aesthetical dimension. The art complex develops itself from the free time (idleness), from the developing of technics and, also, from the experience of agreeable and from the consciousness of the aesthetic. It is considered, undeniably, that much more than approaching by the historical facts about art, it is essential to ontologically recognize them, understanding the needs which are part of the individual’s quotidian as partakers of the human gender. Pese al gran debate teórico en tomo a los aspectos participativos de su filosofía política, el republicanismo ya no puede presentarse como un modelo alternativo a la democracia liberal de nuestros días. Suiza, siendo la república más antigua del mundo, mantiene desde hace siglos instrumentos de participación popular, como los referendos y las iniciativas legislativas, y su función no es marginal, sino que constituye uno de los rasgos más importantes de su sistema político. Sin embargo, éste no deja de ser (...) homologable en su conjunto a los del resto del mundo occidental. Paradójicamente, dada la importancia de sus instituciones republicanas, la Suiza actual posee un sistema de gobierno liberal-representativo en el que la Constitución Federal consagra un conjunto típicamente liberal de derechos y libertades, aun cuando su particular cultura política y ciertas instituciones participativas de origen republicano le otorgan un carácter especial. Between November 11 and 13, 2009, the conference Dal logos dei Greci e dei Romani al logos di Dio was held at the Università Cattolica del Sacro Cuore(in Milan) in memory of Marta Sordi. The meeting is part of a multi-year project of dialogue and analysis exploring philosophical, religious, historical and political issues that were as widespread in classical and late antiquity as they are currently of concern in contemporary debate. The meeting explored the word logos, that has his (...) roots in the classical world before being adopted and used by Christianity as its own. La historia de la literatura fantástica argentina, entre 1850 a 1950, por lo general, reconoce únicamente a dos autoras: Juana Manuela Gorriti y Silvina Ocampo. El largo vacío temporal que hay entre ambas da la impresión de que lo fantástico no fue frecuentado por la escritura femenina. Estudios recientes han contribuido a llenar ese vacío, señalando a Eduarda Mansilla y Raimunda Torres y Quiroga como asiduas colaboradoras en revistas y diarios decimonónicos, donde continuaron el camino trazado por Gorriti; sin embargo, (...) aún hay un periodo de alrededor de cinco décadas en el que, en apariencia, las autoras no se dedicaron a escribir relatos fantásticos. Esta “zona desierta”, que se verifica en antologías y estudios del género, resulta llamativa, pues contradice lo que ocurría en ese territorio: en ese lapso, Darío (radicado en Buenos Aires en la década de 1890), Lugones, Holmberg y Quiroga publicaron obras que llevaron a la canonización del relato fantástico. Si bien es cierto que las autoras no alcanzaron el reconocimiento que los escritores mencionados, sí incursionaron en la literatura fantástica, pero sus textos permanecieron, en su mayoría, en las páginas de publicaciones periódicas. El presente trabajo es una modesta contribución en la difícil tarea de mostrar la participación de las narradoras en la literatura fantástica argentina de principios del siglo pasado. Para este propósito, se analizan, desde la perspectiva de la ginocrítica, cinco cuentos prácticamente desconocidos de María del Carmen Alonso, Olga de Adeler, Lola S. B. de Bourguet, Alfonsina Storni y Emma Felce. (shrink)

Proprio perché fuori moda è bene occuparsi di Kelsen – è questa la convinzione sottesa ai contributi qui pubblicati di Bernardo Sordi, Sara Lagi e Carlos M. Herrera. E proprio per fare emergere l’eccentricità di Kelsen rispetto al mainstream giusfilosofico contemporaneo e, quindi, proprio per questo motivo, la sua perdurante attualità, gli autori hanno trattato del suo pensiero a partire da un’angolatura diversa da quella consueta – una prospettiva “al di là della purezza”.

Why is ordinary language vague? We argue that in contexts in which a cooperative speaker is not perfectly informed about the world, the use of vague expressions can offer an optimal tradeoff between truthfulness (Gricean Quality) and informativeness (Gricean Quantity). Focusing on expressions of approximation such as “around”, which are semantically vague, we show that they allow the speaker to convey indirect probabilistic information, in a way that can give the listener a more accurate representation of the information available to (...) the speaker than any more precise expression would (intervals of the form “between”). That is, vague sentences can be _more informative_ than their precise counterparts. We give a probabilistic treatment of the interpretation of “around”, and offer a model for the interpretation and use of “around”-statements within the Rational Speech Act (RSA) framework. In our account the shape of the speaker’s distribution matters in ways not predicted by the Lexical Uncertainty model standardly used in the RSA framework for vague predicates. We use our approach to draw further lessons concerning the semantic flexibility of vague expressions and their irreducibility to more precise meanings. (shrink)

In this article an attempt is made to detect what could have been the dialectical reasons that impelled the Cār-vāka thinker Udbhatabhatta to revise and reformulate the classical materialistic concept of cognition. If indeed according to ancient Cārvākas cognition is an attribute entirely dependent on the physical body, for Udbhatabhatta cognition is an independent principle that, of course, needs the presence of a human body to manifest itself and for this very reason it is said to be a peculiarity of (...) the body. Therefore, Udbhatabhatta seems to de-scribe the cognizing faculty according to a double ontology: it is both a principle and a characteristic, both inde-pendent and dependent. Two philosophical contexts—Vaisesika and Nyāya schools—are here taken into account as possible anti-Cārvāka fault-finding points of view that spured Udbhatabhatta to reconsider the Cārvāka per-spective. Although we do not have so much textual material on this particular aspect of the ancient and medieval philosophical debate in India, it nonetheless can be supposed that Udbhatabhatta’s reformulation of the concept of cognition was a tentative response to the Vaisesika idea that cognition is not an attribute of the body, rather of the mind (which is here supposed to be eternal), and to the Naiyāyika perspective according to which cognition would be an attribute of an everlasting self. In the case of the Nyāya school, fortunately we have at our disposal the criticism put forward by Vātsyāyana against the materialistic conception of cognition during this time. By examining some Vātsyāyana’s objections, it will emerge that Udbhatabhatta’s idea of cognition really seems to have the aspect of a consistent answer to them, from a renewed materialistic point of view. Obviamente, el término transición es aplicable a la familia que, aunque en un tiempo determinado se concebía en nuestro país como exenta de cambios, hoy se reconoce como sujeta a múltiples transformaciones. De ella me voy a ocupar (...) a continuación haciendo hincapié de la reversibilidad o irreversibilidad de sus transiciones. ¿Son o no definitivas? ¿Todas o solamente algunas? ¿Ninguna, quizás? Mi objetivo es, sobre todo, poner de manifiesto cómo redefinen las transiciones a una institución tan omnipresente, en el tiempo y en el espacio, como la familia.…. (shrink)

The Constitutional State, in its initial configuration as a liberal Constitutional State, recognised a series of basic individual rights as fundamental rights. Subsequently, in the second half of the 20 th century, social, economic and cultural rights were integrated into the Constitution, creating the social Constitutional State. However, although said group of rights are always mentioned as a compact group, or a package of rights, in fact the second recognition only took place, in the strictest sense, with respect of social (...) and economic rights, and, to a much lesser degree, in respect of cultural rights. Largely, the cultural rights are forgotten rights in the Constitutional State, but today our society is multicultural. This is a contradiction. The text provides the basis for a progressive recognition of cultural rights in the Constitutional State. Also, the text discusses the benefits for all if we consider these rights as rights of the person, that is, as rights of all persons and not only of minorities. (shrink)

Los trabajos que se presentan en este volumen son un intento de replantear la problemática noción de humanismo en un mundo deshumanizado. El hilo conductor de sus planteamientos no es la oposición humanismo-antihumanismo, o naturaleza-técnica, sino la sospecha de que por debajo o por detrás de la tradición dominante del humanismo moderno puede localizarse una tradición diferente de reflexión sobre la humanitas del hombre.De este modo, el libro pretende rastrear en la historia del pensamiento una forma distinta de humanismo, aquella (...) a la que se puede llegar a través dela obra de Kant y en particular de su Crítica del Juicio. Más acá del humanismo de raíz cartesiana y corte subjetivista, se puede localizar también en la época moderna una corriente que dibuja a partir del pensamiento de Kant y del proyecto ilustrado otra definición posible de la humanidad del hombre. En virtud del lugar que ocupa el lenguaje en esta definición de la humanidad, el libro rescata y pone en valor una consideración de los «estudios de humanidades» de origen renacentista que esta corriente hacía valer y que corre el riesgo de ser definitivamente invisibilizada en nuestros días.Autores de la talla de Antonio Valdecantos, Marco Díaz Marsá, Luis Alegre o Felipe Martínez Marzoa, entre otros, agitan los términos de un debate que nos concierne a todos. What is the value of fictions, metaphors, figures and scenarios in adjudication? This book develops three models to help answer that question: inquiry, artefacts and imagination. -/- Legal language, it is argued, contains artefacts – forms that signal their own artifice and call upon us to do things with them. To imagine, in turn, is to enter a distinctive epistemic frame where we temporarily suspend certain epistemic norms and commitments and participate actively along a spectrum of affective, sensory and kinesic (...) involvement. -/- The book argues that artefacts and related processes of imagination are valuable insofar as they enable inquiry in adjudication, ie the social (interactive and collective) process of making insight into what values, vulnerabilities and interests might be at stake in a case and in similar cases in the future. -/- Artefacts of Legal Inquiry is structured in two parts, with the first offering an account of the three models of inquiry, artefacts and imagination, and the second examining four case studies (fictions, metaphors, figures and scenarios). -/- Drawing on a broad range of theoretical traditions – including philosophy of imagination and emotion, the theory and history of rhetoric, and the cognitive humanities – this book offers an interdisciplinary defence of the importance of artefactual language and imagination in adjudication.
